Terms of Service

1. The service

Ember is a multi-company workspace operating system for project delivery, approvals, communications and commercial records. Ember Labs provides the software; each customer remains responsible for its projects, personnel, decisions, contracts and professional obligations.

2. Accounts and company authority

You must provide accurate account information and protect your sign-in credentials. A person creating or administering a company workspace confirms that they are authorized to act for that company. Company administrators control invitations, roles, departments and access within their workspace.

3. Acceptable use

You may not use Ember to:

• Break applicable law, infringe rights or distribute unlawful or deceptive content.
• Send spam, bypass recipient consent or abuse a connected communications provider.
• Attempt unauthorized access, disrupt the service or evade security controls.
• Upload malicious code or use another company's information without authority.
• Misrepresent an automated message as a message independently written by a person.

4. Customer data and permissions

Customers retain their rights in the information they submit. They authorize Ember Labs and its service providers to process that information only as needed to operate, secure and support Ember. Customers are responsible for the accuracy of their records and for assigning appropriate access and approval authority.

5. Automations, drafts and approvals

Automations and generated drafts assist authorized users but do not replace accountable business judgment. Ember may require human approval for content involving scope, price, cost, schedule, purchasing, contracts, sensitive information or low confidence. Users must review outputs before relying on or sending them.

6. Third-party services

Optional integrations such as identity, email or payment services are governed by their providers' terms as well as these terms. The customer authorizes only the permissions it chooses to connect and can disconnect supported integrations through Ember.

7. Fees and subscriptions

Applicable plans, seat limits, billing periods, taxes and onboarding services will be shown in the accepted order or checkout. Unless that agreement says otherwise, paid fees are non-refundable except where required by law. Ember will not represent a payment as complete until the configured payment provider verifies it.

8. Availability and changes

Ember Labs works to keep the service reliable and secure, but availability is not guaranteed unless a separate agreement states a service level. Features may change to improve security, comply with provider requirements or develop the product. Material changes affecting customer use will be communicated appropriately.

9. Suspension and termination

Access may be suspended for non-payment, security risk, unlawful use or material breach. Customers may request termination and data handling assistance through the support page. Required business, security and audit records may be retained as described in the Privacy Policy.
